By accessing our website, engaging with our services, or signing a contract with LeadCrew, you agree to be bound by these Terms or Conditions. Services and Agreements

All services provided by LeadCrew will be outlined in a separate proposal, contract, or statement of work (SOW). The scope, timeline, and fees for each project will be agreed upon in writing before work commences. Any changes to the scope of work must be approved in writing by both parties and may result in additional fees or extended timelines. LeadCrew will make every effort to deliver services in a timely and professional manner, but we cannot guarantee specific outcomes or results, as these may depend on factors beyond our control.

Client Responsibilities

As a client, you agree to provide accurate, complete, and timely information required for the execution of services. You are responsible for responding to communications and requests for approvals within a reasonable timeframe. Failure to do so may result in delays in project delivery. You also agree to make payments as per the agreed schedule and to refrain from engaging in any activity that may harm the reputation of LeadCrew or its team. Additionally, you must ensure that all materials provided to LeadCrew, such as logos, content, or images, are free from legal disputes and do not infringe on third-party rights.

Fees and Payment

All fees for services will be outlined in the proposal, contract, or SOW. Payments must be made in the currency specified in the agreement, such as USD or PKR. A deposit or advance payment may be required before work begins. Refunds will only be issued under circumstances outlined in the agreement or as required by law. LeadCrew reserves the right to withhold deliverables until full payment is received.

Intellectual Property

All intellectual property created by LeadCrew during the project, including designs, content, strategies, and code, will remain the property of LeadCrew until full payment is received. Upon full payment, the client will be granted a non-exclusive, non-transferable license to use the deliverables for their intended purpose. LeadCrew reserves the right to showcase the work in its portfolio, case studies, or marketing materials unless otherwise agreed in writing. The client is responsible for ensuring that any third-party materials used in the project, such as stock images or fonts, are properly licensed.

Protecting confidential information

Both parties agree to maintain the confidentiality of any sensitive information shared during the project. Confidential information will not be disclosed to third parties without prior written consent. This obligation of confidentiality will survive the termination of the agreement. LeadCrew will take reasonable measures to protect the confidentiality of client information but cannot guarantee absolute security due to the inherent risks of digital communication and storage.

Limitation of Liability

LeadCrew will not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim will not exceed the total fees paid by the client for the specific service in question. LeadCrew is not responsible for any losses or damages resulting from third-party actions, including but not limited to changes in search engine algorithms, social media platform policies, or website hosting issues. The client acknowledges that digital marketing outcomes are influenced by numerous external factors beyond LeadCrew’s control.

Governing Law and Dispute Resolution

These conditions of service are governed by the laws of Pakistan. Any disputes arising out of or related to these terms will be resolved through arbitration in Karachi, Pakistan, following the Arbitration Act of Pakistan. Both parties agree to participate in good faith in the arbitration process and to abide by the negotiator’s decision.

Right to raise charges or make revisions to terms of the agreement

LeadCrew reserves the right to update or modify these Terms at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the revised terms. For clarity and transparency, we recommend that clients review these terms regularly. LeadCrew will make reasonable efforts to communicate changes to clients via email or through our website.

Use of Third-Party Services

LeadCrew may use third-party tools, platforms, or services, such as Google Ads, Facebook Ads, or WordPress, to deliver our services. The client acknowledges that these third-party services are subject to their terms and conditions, and LeadCrew is not responsible for any issues arising from their use. The client is responsible for complying with the terms of any third-party platforms used in connection with our services.

Warranties and Guarantees

LeadCrew makes no guarantees regarding the outcomes or results of our services, including but not limited to search engine rankings, website traffic, or sales conversions. While we strive to deliver high-quality services, we do not warrant that our services will be error-free or uninterrupted. The client acknowledges that digital marketing involves inherent uncertainties and that results may vary based on factors beyond LeadCrew’s control.

Indemnification

The client agrees to indemnify and hold LeadCrew harmless from any claims, damages, or losses arising out of the client’s use of our services or deliverables. This includes any breach of these terms or conditions by the client or any third-party claims related to materials or information provided by the client. The client is responsible for ensuring that all content and materials provided to LeadCrew comply with applicable laws and do not infringe on third-party rights.

Entire Agreement

These conditions of service, along with any proposals, contracts, or Statement of Work [SOWs], constitute the entire agreement between the client and LeadCrew. Any prior agreements, understandings, or representations are superseded by this document. No oral or written statements outside of these terms will be binding unless explicitly agreed upon in writing by both parties.

Validity and Continuation of Terms

If any provision of these conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the intent of the original provision.
